Purpose of Personal Data Processing

The purpose of processing personal data is to use such data to fulfill a consumer contract entered into between the seller and the buyer through the creation of an order in this online store. This consumer contract also serves as the legal basis for the processing of the buyer's personal data. Providing personal data is a contractual requirement necessary for the conclusion of the contract. The provision of personal data is a condition for making a purchase in the seller’s online store. If the buyer does not provide all the required personal data to the seller, it may result in the inability to conclude the purchase contract.

The seller processes personal data in accordance with Act No. 18/2018 on the Protection of Personal Data and processes only the data necessary for concluding the consumer contract.

The seller processes standard personal data of the buyer.

The buyer’s personal data are stored in the seller’s information system for a period of 10 years.

The buyer has the right and the opportunity to update personal data online on the e-shop website in the customer section after logging in, or via other means (email, in writing).

Disclosure of Personal Data to Third Parties

Personal data may be provided to third parties for the purpose of fulfilling the consumer contract – specifically to delivery companies (couriers) and to an accounting services provider.

Therefore, personal data will not be provided to other third parties, except for the aforementioned delivery and accounting service providers.

The buyer’s personal data will not be publicly disclosed.

The seller may provide the buyer’s personal data (limited to the email address) to Heureka Shopping s.r.o. exclusively for participation in the "Verified by Customers" program, to collect feedback on the buyer’s purchase experience.

Buyer’s Rights

The buyer has the right to obtain confirmation from the seller regarding which personal data about them are being processed by the seller’s online store. The buyer has the right to access such data and obtain information regarding the purpose of processing, categories of data being processed, recipients of the data, retention period, and whether automated individual decision-making, including profiling, takes place.

The first provision of the aforementioned personal data to the buyer is free of charge. Repeated provision of such data, upon request, will be subject to an administrative fee of €5.

The buyer has the right to request the correction or completion of incomplete personal data, the erasure of personal data, or restriction of their processing. The buyer also has the right to object to the processing of personal data.

The processing of the buyer’s personal data is also necessary for archiving purposes (to fulfill the seller’s legal obligations under Slovak law, e.g., retention of accounting documents for 10 years). If the buyer requests erasure of personal data processed in connection with the purchase contract, such a request may be denied.

The buyer has the right to request that the seller restrict processing if the buyer contests the accuracy of the personal data, for a period enabling the seller to verify their accuracy.

The buyer has the right to obtain the personal data they provided to the seller in a structured, commonly used, and machine-readable format. The buyer also has the right to transmit those data to another controller, where technically feasible.

The buyer has the right to object to the processing of personal data for direct marketing purposes, as well as for the seller’s legitimate interests.

In case of suspicion that their personal data are being processed unlawfully, the buyer may lodge a complaint with the Slovak Data Protection Authority.

Pre-Contractual Relationships

The above information on data protection also applies to pre-contractual relationships (e.g., registration in the e-shop for future purchases or requesting a quote or information about the seller's products and services).

Use of Cookies

To ensure the proper functioning of the online store, the seller may store small data files — cookies — on the buyer’s device. These cookies allow the online store to retain information about user activity and preferences (such as login name, language, font size, etc.) for a certain period. The seller’s online store uses cookies to remember the buyer’s preferences, ensure essential functionality, and for marketing purposes.

The buyer can delete all cookies stored on their device and configure their browser to prevent the storage of cookies. However, doing so may require manual adjustment of some settings upon each visit, and certain services or features of the online store may not function properly.
